Legal nonlicensed provider annual monitoring

Federal law requires that any child care provider who receives funds through the Child Care and Development Fund (CCDF) and cares for unrelated children meets certain health and safety requirements. Agencies monitor legal nonlicensed providers to ensure that they are providing care that meets baseline standards.

• Providers can evaluate the care environment using a home safety checklist DHS-5192B-ENG (PDF)

• Providers must have an emergency plan DHS-7414B-ENG (PDF) to keep children safe in an emergency
• Agencies monitor providers caring for unrelated children using the Legal Nonlicensed Provider Monitoring Checklist DHS-7867-ENG (PDF). 

The department posts information about providers by a Provider ID number. If you are a parent or provider, you can find your provider ID number on your Service Authorization. If you are a provider and have questions or believe a monitoring visit summary is inaccurate, contact your local Child Care Assistance Program agency. 

If your provider is not listed, they haven’t had a monitoring visit. Agencies have up to one year after a provider is authorized to care for an unrelated child to complete the monitoring visit. Providers that do not care for unrelated children are not monitored.

If a provider does not comply with a checklist standard, it may be able to fix the issue during the visit or submit additional documentation that they’ve fixed the issue. This is a corrective action. When the provider has met the requirements of the checklist through a corrective action, it is recorded in this part of the summary.

If a child has died or been seriously injured in this provider’s care, it must be reported on the annual monitoring summary. A serious injury is one which requires treatment by a physician. If the injury or death was a result of substantiated maltreatment, the provider is no longer eligible to care for children as a legal nonlicensed provider.
